Terms of Service

These Terms of Service ("Terms") govern your access to and use of the MarketPro mobile application, this website, and any related services (together, the "Service"). The Service is operated by Harajuku Holdings LTD ("MarketPro", "we", "us" or "our"). By downloading, accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Acceptance of these terms

By creating an account or otherwise using the Service, you confirm that you have read, understood and agree to these Terms and to our Privacy Policy, which is incorporated here by reference. These Terms form a binding agreement between you and MarketPro.

2. Eligibility

You must be at least 18 years old and have the legal capacity to enter into a binding contract to use the Service. You are responsible for ensuring that your use of the Service, and any trading activity you undertake, is lawful in your country of residence. The Service is not offered to, or intended for use by, any person in a jurisdiction where trading signals or related financial content are prohibited or where doing so would subject us to any registration or licensing requirement. We may restrict or block access from certain jurisdictions at our discretion.

3. The service

MarketPro provides:

• Trading signals — trade ideas for foreign-exchange and related instruments, including a suggested direction, entry, take-profit and stop levels, generated by an automated strategy engine and reviewed before publication;
• Educational content — lessons, quizzes, a glossary, calculators and other learning material (the "Academy");
• Rewards features — a free daily signal, referral rewards, streaks and cashback perks.

The Service is a source of information and education only. We do not execute trades, hold client funds, manage accounts, or act as a broker, dealer, exchange or financial adviser. Any trade you place is placed by you, in your own account, with a broker of your own choosing, entirely at your own discretion and risk.

4. Not investment advice

The content provided through the Service, including all signals, levels, analysis and educational material, is provided for general informational and educational purposes only. It does not constitute investment advice, financial advice, trading advice, a personal recommendation, or a solicitation or offer to buy or sell any financial instrument. It does not take into account your personal circumstances, financial situation, objectives or risk tolerance. You should not treat any content in the Service as such, and you should obtain independent professional advice before making any trading or investment decision.

5. Risk disclosure

Trading foreign exchange and other leveraged products carries a high level of risk and may not be suitable for everyone. You may lose some or all of your invested capital, and you should not trade with money you cannot afford to lose. Leverage can work against you as well as for you.

Past performance is not indicative of, and is no guarantee of, future results. Any performance figures, win rates, track records or hypothetical results shown anywhere in the Service or on this website are historical or illustrative, are not a promise of future performance, and should not be relied upon as such. You are solely responsible for any decision you make and for any resulting gains or losses.

6. Your account

To use certain features you must create an account. You agree to provide accurate information and to keep your login credentials secure. You are responsible for all activity under your account. Notify us promptly at support@getmarketpro.app if you suspect unauthorised use. You may delete your account at any time from within the app; deleting your account removes your profile and associated personal data as described in our Privacy Policy.

7. Subscriptions & billing

Some features require a paid subscription ("Premium"). Premium is sold as an in-app purchase and is billed through the Apple App Store or Google Play, subject to their respective terms.

• Payment is charged to your App Store or Google Play account at confirmation of purchase.
• Auto-renewal. Subscriptions renew automatically at the end of each billing period unless you cancel at least 24 hours before the period ends. Your account is charged for renewal within 24 hours of the end of the current period.
• Free trials or introductory offers, where offered, convert to a paid subscription at the stated price unless cancelled before the trial ends. Any unused portion of a free trial is forfeited when you purchase a subscription.
• Managing and cancelling. You can manage or cancel your subscription at any time in your device's subscription settings (App Store or Google Play). Cancellation takes effect at the end of the current billing period.
• Refunds are handled by Apple or Google under their policies. We do not directly process payments and cannot issue refunds for store-billed purchases; please use the store's refund process.

Prices may change; any change will apply to future billing periods and, where required, will be notified to you in advance.

8. Free signal, rewards & referrals

We may offer a free daily signal, referral rewards, streak rewards, cashback perks and other promotions. These are provided at our discretion, may be changed, limited or withdrawn at any time, have no cash value, and may not be sold, transferred or combined except as we permit. We may withhold or revoke rewards obtained through fraud, abuse, self-referral, fake accounts or any breach of these Terms.

9. Acceptable use

You agree not to: (a) use the Service for any unlawful purpose; (b) copy, scrape, redistribute, resell or publicly share signals or content without our written permission; (c) reverse engineer, decompile or attempt to extract source code, except where permitted by law; (d) interfere with or disrupt the Service or its security; (e) create accounts by automated means or misrepresent your identity or location; or (f) use the Service in a way that infringes the rights of others.

10. Intellectual property

The Service, including its software, design, text, graphics, logos, the MarketPro name and mark, signals and educational content, is owned by MarketPro or its licensors and is protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Service for your own personal, non-commercial use in accordance with these Terms. No other rights are granted.

11. Third-party services

The Service relies on and may link to third-party services (for example, app stores, brokers, payment and analytics providers). We are not responsible for third-party services, their content, or their terms and privacy practices. Your dealings with any broker or other third party are solely between you and that party. Choosing a broker, funding an account and placing trades are entirely your own decisions.

12. Disclaimers

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any signal, level, figure or piece of content is accurate, complete, timely or profitable. Market data may be delayed or inaccurate.

13. Limitation of liability

To the maximum extent permitted by law, MarketPro and its officers, directors, employees and affiliates will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data, goodwill, or any trading losses, arising out of or relating to your use of, or inability to use, the Service, even if we have been advised of the possibility of such damages. To the maximum extent permitted by law, our total aggregate liability for any claim relating to the Service will not exceed the greater of (a) the amount you paid us for the Service in the twelve months before the event giving rise to the claim, or (b) USD 100. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

14. Indemnification

You agree to indemnify and hold harmless MarketPro and its affiliates from any claims, damages, losses, liabilities and expenses (including reasonable legal fees) arising out of your use of the Service, your trading decisions, your violation of these Terms, or your violation of any law or the rights of any third party.

15. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service at any time, with or without notice, if you breach these Terms or if we discontinue the Service. Sections that by their nature should survive termination (including sections 4, 5, 10, 12, 13 and 14) will survive.

16. Changes to these terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date and, where appropriate, notify you in the app. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

17. Governing law

These Terms are governed by the laws of the Republic of Cyprus, without regard to its conflict-of-laws rules, and the courts of Cyprus will have exclusive jurisdiction over any dispute, except where mandatory consumer-protection laws of your country of residence grant you additional rights or a different forum.
